Processing of personal data – privacy notice
L&L Advokatbyrå AB (”L&L”), 559176-1274, is the data controller for the personal data of contact persons that we receive due to assignments or that otherwise is processed when we prepare or administrate an assignment. You are not obliged to provide personal information to us, but if you choose not to, we cannot undertake an assignment since we are unable to carry out the mandatory controls of conflict of interest and (if applicable) take the actions required under the money laundering regulations.
The data that is processed includes mainly the information that you provide us with via e-mail or otherwise, in connection with that we perform work for you or the legal entity that you represent. We process information about your name, your contact details (such as your address., e-mail and telephone number), employer, copies of ID card and other information that the is required due to the assignment. In addition, we may gather information from other sources than yourself, such as public web pages, databases and authorities.
Exceptionally we may process data that, according to the data privacy legislation, may be regarded as sensitive (i. e., data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or data concerning health or a natural person’s sex life). That happens when the assignment so requires (for example in labour law related matters regarding duty to negotiate with concerned trade unions, rehabilitation duties or claimed discrimination).
We process the personal data to carry out mandatory controls of conflict of interest and (if applicable) take the actions required under the money laundering regulations, perform and manage our assignment, to safeguard your and our interests related to the assignment and for accounting and invoicing purposes. The data is treated on the basis of our performance of the contract regarding legal services that we enter with you, or for the fulfilment of legal obligations to which we are subject. Data may also be processed if it is necessary in order to establish, claim or defend your legal rights.
The data can also be used for market and client analysis, statistics, risk management and business and method development. Personal data may also be used for distribution of newsletters, invitations to seminars and other marketing activities. The data processed for the purpose of developing and analysing the business is treated on the basis of our legitimate interest in developing our business and communication with our customers and potential customers.
The data that we process is to a large extent covered by legal privilege. We will not disclose personal information to third parties other than in the case
- it is specifically agreed with you,
- in the context of a particular assignment, it is necessary in order to protect your rights,
- it is necessary in order for us to comply with statutory duty or to comply with authority decisions or court decisions,
- it is necessary in order to protect our legal rights, or
- in case we engage third-party service providers who perform services on our behalf.
The information may be disclosed to courts, authorities, counterparties and counterparty counsels if necessary to safeguard your rights.
The personal data that we process will mainly be processed within the EU/EEA. However, personal data may be transferred to a third country as part of our assignment and for the purposes stated above. In such case, we will make sure that the transfer is covered by reasonable security measures in accordance with EU’s General Data Protection Regulation.
We do not keep information for longer than necessary for the purposes for which the personal data are processed, unless the information must or may be stored for a longer period of time according to law. The personal data that is processed in connection with the performance of an assignment will be stored, in accordance with the obligation imposed on L&L under the Swedish Bar Association’s ethical guidelines, during a time period of ten years from the completion of the case, or the extended time period required by the nature of the matter. If you unsubscribe from newsletters or similar, our use of the information for that purpose, will immediately stop and the information will be deleted.
You are entitled to request information from L&L on the use of personal data relating to you. We will correct or delete information that is incorrect or limit the processing of such information at your request. If you are dissatisfied with our treatment of data, you may file a complaint with the Swedish Data Protection Authority. You may also turn to the supervisory authority in the country where you live or work.
